I’ve Been Hit By An Uninsured Driver; Now What?

In Louisiana, in order to be a valid driver, you must carry at least $15,000 in liability coverage. Your liability coverage is what pays the victim of an accident when it was your fault. Because the minimum legal requirement for liability insurance is $15,000, unfortunately, most drivers carry only that minimum amount.

But what happens when an accident is not your fault, but the person who caused your accident carries only that minimum $15,000 limit? More importantly, what happens when that person’s $15,000 liability policy is not enough to cover all of your damages? That is where UM coverage comes in. It is the coverage you buy to protect yourself from the situations when another driver injures you through his fault, but he either did not carry insurance at all (uninsured driver) or, more often, he did not carry enough liability insurance to cover your injuries (underinsured driver). Your UM insurance applies to add another layer of protection and stands in the shoes of the other driver to supplement what he owes you for your damages.

$15,000 may seem like a large sum of money, but, in reality, it is pennies compared to how expensive medical care can be after an accident. In many cases, when an individual is involved in an accident, the at-fault driver is either uninsured or doesn’t have enough insurance. You should not have to suffer for driving legally and paying insurance premiums while the other driver was doing just the opposite. With the help of an experienced attorney, you can determine all of the layers of insurance that are available to pay for your injuries.

“I have devoted many of my Legal Minute series to explaining the purpose of uninsured or underinsured motorist coverage, encouraging everyone to not only include it when they buy vehicle insurance, but to increase it. As your attorney, I am often limited by how much insurance is out there, no matter how severe your injuries are, and UM coverage is often the only thing standing in the way of your financial independence after an injury.” — Attorney Gregory P.
