The rising concerns over unregulated kratom products

On Behalf of | Mar 6, 2025 | Personal Injury

It seems harmless — a quick way to get a boost in energy. Some manufacturers even market it as a natural way to live “healthier and happier” lives. What they do not tell you are the dangers. In recent years, kratom, a tropical tree native to Southeast Asia, has gained popularity in the United States as a supplement used for pain relief, mood enhancement, and opioid withdrawal assistance. The supplement is available online and at drug stores or gas stations throughout the country, yet the United States Food and Drug Administration (FDA) warns consumers not to use kratom because it can lead to serious adverse effects including seizures and death.

What is even more frustrating is the fact that there is minimal regulation to control the sale of these products. The public is fighting back. The concerns regarding the lack of regulation and the reality of the dangers of this product has led to an increase in lawsuits against manufacturers.

Key issues with unregulated kratom products

The absence of regulations for kratom products poses various risks and legal complexities including:

  • Quality control inconsistencies: Without regulatory standards, product potency and purity can vary, leading to potential health risks.
  • Misleading claims: Manufacturers may make unverified claims about the benefits of their products.
  • Lack of dosage guidelines: Without clear, regulated guidelines, consumers risk overuse or misuse.

These issues not only endanger public health but also complicate the legal landscape surrounding kratom use.

Increase in legal actions against kratom manufacturers

The lack of regulation has not only impacted users but has also led to a rise in legal challenges. Product liability lawsuits are moving forward, involving consumers who experience adverse effects seeking legal recourse against kratom manufacturers. Lawsuits that focus on deceptive marketing practices are also on the rise.

The surge in popularity of kratom in the U.S. has outpaced the establishment of necessary regulatory measures, leading to significant public health concerns and a growing number of lawsuits. Consumers and legal professionals alike are calling for enhanced oversight to address the risks associated with unregulated kratom products. Until such regulations are in place, it is likely that legal actions against manufacturers will continue to increase.
